(a) Mediation:
Our experienced staff may act as impartial and neutral experts in assisting parties to negotiate and resolve their differences under construction contracts.
(b) Adjudication:
Covenant are fully capable of assisting parties in the preparation of their submissions to an adjudicator in cases of disputes, all in accordance with the relative rules determined in their construction contracts.
(c) Arbitration:
Our team of experts may also assist in the preparation and presentation of arbitral submissions to an arbitrator in accordance with the relative rules determined in the construction contract and under the applicable arbitration law.
All contemporary construction contracts contain provisions which give rights to the Contractor to claim, under particular circumstances, for additional time and/or time related costs in connection with events which disrupt the Works progress and/or prolong the agreed construction period. Our team of experts provides services to our clients in the following disciplines:
(a) Preparation of Statements of Defence on behalf of Employers against Contractors claims
As your consultant in defense claims, Covenant CCC Ltd ensures proper documentation is maintained so that the Contractor receives his rights under the relevant construction contracts by following an elaborate process comprising of the following: Review of the Project and Contract details, identification of contractual rights to claim, examination of documentation referred to in the Contractor’s claim as well as further relevant documentation, review and evaluation of any contractual analysis and /or delay analysis included in the claim, selection of supporting evidence, preparation of a Draft Statement of Rebuttal for the Employer’s review and comments and finally submission to the Employer of the Final Statement of Rebuttal. At the Employer’s request, Covenant may also be commissioned to prepare counter claims.
(b) Preparation of Merit Reports for Employers or Contractors
Merit Reports may be requested from time to time by Clients wishing to understand their relative positions with regards to existing disputes under a construction contract. Following an extensive and thorough analysis of project documentation, Covenant CCC Ltd highlights the Clients’ strengths and weaknesses with regards to issues in dispute and advises the Client on the way forward considering all relevant circumstances.
(c) Preparation of Claim Reports
Covenant CCC Ltd specializes in the preparation of claims under construction contracts, whether initiated by Employers, Contractors or Subcontractors. Following its appointment as a Claims Consultant, Covenant CCC Ltd familiarizes itself with relevant Project and Contract details, identifies contractual rights to claim and examines of all relevant documentation for the selection of supporting evidence. Subsequently, Covenant CCC Ltd initiates the preparation of a narrative containing all relevant facts and a contractual analysis determining the entitlement for each head of claim. Following the establishment of contractual breaches, a delay analysis is performed and time related costs – as well as other monetary claims – are calculated and complied, and accordingly a Statement of Claim is drafted for the Client’s review and comments prior to the issuance of a Final Statement of Claim.
Our expert senior staff undertake duties of managing Construction Contracts on behalf of Contractors from the stage of the commencement of the construction project until the settlement of the account and the issue of the Final Payment Certificate. We manage all inter contractual relations in the project in support of the Contractor’s contractual obligations and rights.
Similarly to the provision of contract management services to contractors, we play the role of Contract Administrators in Construction Contracts on behalf of Employers throughout the project life cycle.
